When people hear the term ‘No Win No Fee,’ they always wonder what the catch is, but there is no catch. Would you pay for a service if you were not happy with it?
No you wouldn’t, you would make sure you got the very best service for what you’re paying for. Why should it be any different in the legal world? Why should you pay a legal representative if you’re going to lose the case? Why not just pay if or when you win?
When you discuss your claim with a Solicitor at the very outset, the Solicitor will assess whether the claim has any merits. If the prospects are generally above 50%, they may offer to act for you on a no win, no fee basis. Once an agreement has been entered in to, you will no doubt have some obligations to co-operate and give honest instructions to them.
That being the case, then you will only become liable for their charges once the claim has successfully settled. Note that should you fail to comply with any of your obligations, then the no win, no fee agreement could well become null and void, leaving you liable for the Solicitors fees.
The obligations of the Solicitor will generally require them to act in a professional way and use their best endeavours to achieve the best outcome for you. The solicitor will ensure to keep you updated with any relevant developments on your case. Subject to you meeting your own obligations, the agreement should confirm that you are not liable for their fees until a successful conclusion has been reached.
A fourteen day cancellation period should be included within the agreement, in the event that you choose not proceed with the claim via your chosen Solicitor.
